The Biden administration has filed a new legal challenge to reinstate federal mask mandates on planes.

In April a federal court overturned the Biden administration mask mandate for planes. Now, the Department of Justice has filed a legal challenge to have it reinstated.
It remains unclear whether this legal challenge will be successful. In the court ruling to overturn the mandate, U.S. District Judge Kathryn Kimball Mizelle said the CDC mandate was “unlawful.”
“But the mandate exceeded the CDC’s statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions,” she wrote
Biden’s decision drew pushback.
